Villa World is using the courts to force through the West Byron mega development

Last year, after a prolonged struggle and so much hard work, the Byron community convinced the Northern Regional Planning Panel (NRPP) to refuse two Development Applications (DAs) for West Byron.

Now Villa World – the central portion of the site – is back to menace us again.

The landowner has submitted an amended Development Application to the Land & Environment Court for the court to approve. This, in effect, bypasses the usual planning process – the Court will decide the DA; not the NRPP, not Council and not the community.

We ask you to quickly make your submission to Council about this revised DA by 5pm on Wed 30th September . This will be sent on to the Court.

WHAT’S CHANGED IN THE NEW DA?

Thanks to all our efforts, Villa World are halving the number of residential lots, (although secondary dwellings are still possible – and likely), setting the development back 30m from Ewingsdale Road, excluding the habitat of the Wallum frogs from the development area and removing development from the eastern Koala area.

Still, this much development alone would result in:

  1. more than a 10% increase in traffic
  2. importation of over 320,000 tonnes of fill
  3. use of an extra 35 megalitres of water per year from Rocky Creek Dam
  4. Requires private sewage pumps on each property as well as the building of a large sewerage substation pump with a capacity to include new developments in the hospital and Ewingsdale areas
  5. Creates a significant increase in pollutants to the already critically stressed Belongil waterway, our Bay and the Cape Byron Marine Park
